1. Agreement to terms

These Terms of Service ("Terms") govern your access to and use of the StrikeThePose mobile application and website (collectively, the "Service"), operated by Luke Czak ("we", "us", "our"). By downloading, installing, or using StrikeThePose, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Licence to use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes on devices that you own or control.

You may not:

  • Reverse engineer, decompile, or disassemble the app.
  • Rent, lease, lend, sell, redistribute, or sublicense the Service.
  • Use the Service for any illegal or unauthorised purpose.
  • Interfere with or disrupt the integrity or performance of the Service.

3. Your content

You retain all ownership rights to the photos, videos, and other content you create or capture using the Service. We do not claim ownership of your content. You grant us no licence to your content beyond what is necessary to operate the Service on your device.

You are solely responsible for the content you capture, save, export, or share using the Service and for ensuring you have the necessary rights, permissions, and consents (including from people appearing in your photos).

4. Subscriptions and payments

StrikeThePose offers a free tier with optional Pro subscriptions and individual coaching packs available as in-app purchases.

  • Pro Subscription: Auto-renewing monthly or annual subscription that unlocks premium features. Pricing is displayed in-app and may vary by region.
  • Coaching Packs: One-time purchases that unlock specific pose libraries.
  • Billing: All payments are processed by Apple through your Apple ID. We do not collect or store your payment card details.
  • Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time in your Apple ID account settings (Settings → Apple ID → Subscriptions).
  • Free trials: If offered, free trials convert to paid subscriptions automatically unless cancelled before the trial ends.

5. Refund policy

All purchases and subscriptions are subject to Apple's App Store refund policy. Refund requests must be submitted directly to Apple through your Apple ID account or at reportaproblem.apple.com. We do not process refunds directly.

6. Subscription cancellation

You may cancel your subscription at any time through your Apple ID subscription settings. Cancellation takes effect at the end of the current billing period. You will continue to have access to Pro features until the period ends. No partial refunds are provided for unused portions of a subscription period.

7. Disclaimer of warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free.

Coaching tips and AI-generated feedback are suggestions only. We make no guarantee that following coaching guidance will produce any specific photographic result.

8. Limitation of liability

To the maximum extent permitted by applicable law, in no event shall Luke Czak be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

  • your access to or use of or inability to access or use the Service;
  • any conduct or content of any third party on the Service;
  • unauthorised access, use, or alteration of your transmissions or content.

Our total liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the amount you have paid to us for the Service in the twelve (12) months preceding the claim, or (b) £100 GBP.

9. Indemnification

You agree to defend, indemnify, and hold harmless Luke Czak and his affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Service, your content, or your violation of these Terms.

10. Dispute resolution

Informal resolution: Before filing a formal claim, you agree to contact us at luke.czak@gmail.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.

Governing law: These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to its conflict-of-law principles.

Jurisdiction: Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of England and Wales, except where mandatory local law requires otherwise.

EU consumers: If you are a consumer resident in the European Union, you retain any mandatory consumer-protection rights under the law of your country of residence, including the right to bring proceedings in your local courts.

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will cease immediately. Provisions that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

You may stop using the Service at any time by uninstalling the app from your device. Cancellation of a subscription does not terminate these Terms.

12. Changes to terms

We may modify these Terms from time to time. We will notify you of material changes by updating the effective date above and, where appropriate, through an in-app notice. Your continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Third-party services

The Service uses third-party services for analytics (PostHog) and in-app purchases (Apple App Store). Your use of these services is subject to their respective terms and privacy policies.
